A draft law by the Federal Health Department provides for health funds to be supervised by the Federal Cartel Office and to be subject to competition law in future.
The Cartel Office’s task is to examine mergers in terms of anticompetitive behavior and to interfere, as well as to make sure that the health funds do not misuse their market power against the pharmaceutical manufacturers.
The cartel authorities consider the draft to be a very significant step in once again ensuring there is legal certainty for the trade watchdog.
